BTF Sales LLC grants you a limited license to reproduce portions of BTF SALES LLC Properties for the sole purpose of using the Services for your personal or internal business purposes. Unless otherwise specified by BTF Sales LLC in a separate license, your right to use any and all BTF SALES LLC Properties is subject to the Agreement.
You understand that BTF SALES LLC Properties are evolving. As a result, BTF Sales LLC may require you to accept updates to BTF SALES LLC Properties that you have installed on your computer or mobile device. You acknowledge and agree that BTF Sales LLC may update BTF SALES LLC Properties with or without notifying you. You may need to update third-party software from time to time in order to use BTF SALES LLC Properties.
The rights granted to you in the Agreement are subject to certain restrictions including that you shall not commercially exploit or modify BTF SALES LLC Properties without permission. Any unauthorized use terminates the licenses granted by BTF Sales LLC.
In registering an account on the Website, you agree to provide true, accurate, and complete Registration Data. You represent that you meet certain eligibility criteria such as being over 13 years old. You are responsible for all activities that occur under your Account.
If you access the BTF SALES LLC Properties through a SNS, you may link your Account with Third-Party Accounts. BTF Sales LLC may access and make available your SNS Content. You have the ability to disable the connection between your Account and Third-Party Accounts.
Notwithstanding anything to the contrary herein, you acknowledge and agree that you shall have no ownership or other property interest in your Account, and all rights are owned by BTF Sales LLC.
BTF Sales LLC’s confirmation of receipt of your order does not constitute acceptance. BTF Sales LLC is only deemed to have accepted your order once the Product has shipped.
BTF Sales LLC reserves the right to deny any order for any reason. We may also refuse any order connected with a previous payment dispute.
If any Product is discontinued or unavailable, BTF Sales LLC reserves the right to cancel your order and provide a refund.
BTF Sales LLC offers a 30 day return policy on full sized products not previously purchased. Product returns must contain at least half the original volume. BTF Sales LLC reserves the right to not offer refunds to users suspected of abusing this policy.
To protect intellectual property rights, resale of Products for profit is prohibited. BTF Sales LLC reserves the right to decline orders that appear to be for resale.
If any Services are subject to Sales Tax that you have not remitted, you are responsible for payment of such taxes.
You will be responsible for payment of any subscription fees at the time you subscribe. Your participation in any subscription is subject to this Agreement.
After your initial subscription period, your subscription will automatically renew unless you cancel at least 30 days prior to the renewal date.
BTF Sales LLC may create Promo Codes redeemable for Account credit or other features, subject to additional terms.
Any free trial must be used within the specified time period or your use will expire.
You agree BTF Sales LLC and suppliers own all rights, title and interest in BTF SALES LLC Properties.
By submitting Feedback to BTF Sales LLC, you grant us the right to use such Feedback in connection with operating the Services and business.
You have no rights to the Content on BTF SALES LLC Properties, except to Your Content as described herein.
By submitting Reviews and Photographs, you grant BTF Sales LLC the right to use them in connection with advertising and marketing the Products and Services.
BTF SALES LLC Properties may contain links to Third-Party Websites and advertisements. BTF Sales LLC does not review, endorse, or assume responsibility for Third-Party Websites or Ads.
You agree to indemnify and hold harmless BTF Sales LLC Parties from any losses, liabilities, damages and expenses relating to or arising from Your Content, your use of the Services, your violation of this Agreement or applicable laws, or your violation of any third party rights.
YOU EXPRESSLY AGREE THAT YOUR USE OF BTF SALES LLC PROPERTIES IS AT YOUR SOLE RISK. BTF SALES LLC MAKES NO WARRANTIES, REPRESENTATIONS OR CONDITIONS OF ANY KIND.
BTF Sales LLC does not endorse any Content made available through the Services.
BTF Sales LLC is not liable for the conduct of Third Parties or products available through Third Party Websites or Ads.
The Content on BTF SALES LLC Properties is for informational purposes only and should not be relied upon as professional advice. You should seek independent professional advice before acting on any information provided through the Services.
IN NO EVENT WILL BTF SALES LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL OR OTHER DAMAGES ARISING OUT OF OR RELATING TO THE SERVICES OR CONTENT.
IF YOU HAVE PURCHASED PRODUCTS, BTF SALES LLC’S TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID IN THE LAST 6 MONTHS, OR $100 IF YOU HAVEN’T MADE ANY PURCHASES.
These limitations are a fundamental element of this Agreement.
The laws of some states may not allow the exclusion or limitation of certain damages. If these laws apply, some exclusions may not apply to you.
If BTF Sales LLC suspects violations of this Agreement, we reserve the right to investigate and take actions including deleting Your Content, terminating your Account, and cooperating with authorities.
If you breach this Agreement, BTF Sales LLC reserves the right to warn you, delete Content, discontinue your Account or subscription, notify authorities, and restrict your use of the Services.
11. TERM AND TERMINATION
This Agreement continues as long as you use the Services, unless terminated earlier.
BTF Sales LLC may modify or discontinue the Services or terminate your access at any time, with or without notice.
Sections 5-9, 11, 13, and 14 will survive termination of this Agreement.
BTF Sales LLC makes no representation that the Services are appropriate or available for use outside of the United States. Those who access the Services do so at their own volition and are responsible for compliance with local laws.
You and BTF Sales LLC agree to resolve most disputes through binding, individual arbitration. This arbitration agreement precludes class actions.
Before initiating arbitration, an Informal Dispute Resolution Conference must be completed.
Any arbitration will be conducted by JAMS pursuant to its rules and procedures.
The arbitrator, and not a court, will decide issues relating to the interpretation, applicability and enforceability of this arbitration agreement. However, issues relating to the class action waiver may be decided by a court.
This arbitration agreement will survive termination of this Agreement.
You may opt out of arbitration within 30 days of the date you first accepted this Agreement by writing to BTF Sales LLC.
You consent to receive communications from BTF Sales LLC electronically.
You release BTF Sales LLC Parties from claims relating to or arising out of your use of the Services, except claims for fraud, deception or violation of California Civil Code Section 1542.
BTF Sales LLC may modify this Agreement at any time. Changes become effective when posted online. By continuing to use the Services after changes are posted, you agree to be bound by them.
You agree that if you have any issues arising out of your use of the Services, you will first attempt to resolve them by contacting BTF Sales LLC.
This Agreement is the entire agreement between you and BTF Sales LLC relating to use of the Services.
